1. Agreement
These Terms and Conditions (“Terms”) are a contract between you and HERBIDEX, the operator of HBGEN at hbgen.com (“HBGEN”, “we”, “us”). By creating an account or using HBGEN, including its apps, tools and Facebook tools, you agree to these Terms and our Privacy Policy. If you do not agree, do not use HBGEN. If you use HBGEN for a company, you confirm you can bind that company.
2. The service
HBGEN lets you build bio pages, landing pages, smart links, QR codes, forms and digital products, shorten URLs, track results and use marketing tools, including tools that connect to Facebook. We may add, change or remove features. We will try to give notice of changes that significantly reduce a paid feature.
3. Your account
- You must be at least 16 years old and able to form a binding contract.
- Give accurate information and keep your password secure. You are responsible for all activity under your account, including your team members.
- Tell us right away if you suspect unauthorised access.
- One person or business per account unless your plan includes team seats or white-label clients.
4. Plans, billing and renewals
Some features need a paid plan. Prices, limits and billing periods are shown at checkout. By subscribing you authorise us and our payment processors (such as Paystack, Stripe or Flutterwave) to charge you for the plan you chose.
- Renewal. Plans run for the period you paid for and end when it expires unless you renew. Where a plan renews automatically, we tell you before charging.
- Taxes. Prices may exclude taxes, which are added where required.
- Refunds. Payments are generally non-refundable once a period has started, except where the law requires otherwise or we state otherwise at purchase.
- Price changes. We may change prices for future periods with reasonable notice.
- Expiry. When a plan ends, paid features stop. We may limit or restrict content that exceeds free limits. Your data stays available for a reasonable period so you can renew or export it.
5. Your content
You keep ownership of everything you upload or publish (“Your Content”). You give us a worldwide, non-exclusive licence to host, store, display, copy and process Your Content only as needed to run and improve the service for you, for example showing your public pages to visitors.
You confirm that you own Your Content or have the rights to use it, and that it does not infringe anyone’s rights or break the law. You are responsible for Your Content and for complying with the laws that apply to what you sell or promote.
6. Acceptable use
You must not use HBGEN to:
- Break the law or encourage others to, or infringe intellectual property or privacy rights.
- Publish or link to malware, phishing, scams, fake stores, counterfeit goods, adult content involving minors, hate or violent content, or harassment.
- Send spam or run deceptive, misleading or cloaked campaigns, including links that hide the real destination to bypass platform rules.
- Sell or promote anything prohibited by law or by the policies of the platforms you use.
- Attempt to hack, overload, scrape or reverse engineer HBGEN, or bypass limits or security.
- Resell or white-label HBGEN unless your plan allows it.
We may remove content, suspend links or pages, or suspend accounts that break these rules, with or without notice where needed to protect users, visitors or the service.
7. Facebook and other third-party services
HBGEN can connect to third-party platforms such as Facebook and Meta. When you do, you must follow their terms and policies, including the Meta Platform Terms, Meta Advertising Standards and Facebook Terms.
- You may only connect accounts, Pages and ad accounts that you own or are authorised to manage.
- You are responsible for everything you publish, schedule, reply, hide, delete or advertise through the tools, and for the ad spend Facebook charges you.
- HBGEN is not affiliated with or endorsed by Meta. Platforms can change or restrict their features, permissions, limits and approvals at any time, and a feature may stop working because of that without fault on our side.
- Do not use the tools to mass-post, mass-message, scrape, or manipulate engagement in a way that breaks platform rules. Platforms may restrict accounts that do.
8. Digital products and your customers
If you sell products or collect payments through HBGEN, you are the seller. You are responsible for your products, descriptions, delivery, refunds, taxes, customer support and compliance with consumer and data protection laws. We provide the tools only and are not a party to your sales.
9. Intellectual property
HBGEN, its software, design, logo and content we provide are owned by HERBIDEX or its licensors and are protected by law. We grant you a limited, revocable, non-transferable right to use the service under these Terms. These Terms do not give you any right to our trademarks.
10. Copyright complaints
If you believe content on HBGEN infringes your rights, email [email protected] with a description of the work, the URL of the content and your contact details. We will review it and may remove the content.
11. Availability and changes
We aim for a reliable service but do not promise it will always be uninterrupted or error-free. We may carry out maintenance or suspend features when needed. Features, limits and integrations may change.
12. Termination
You can stop using HBGEN and delete your account at any time (see Data Deletion). We may suspend or end your access if you break these Terms, create risk or legal exposure for us or others, or do not pay. On termination your right to use the service ends and we may delete your content after a reasonable period. Sections that by their nature should survive (such as ownership, payment owed, disclaimers and limits of liability) will survive.
13. Disclaimers
HBGEN is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy of statistics and results, and uninterrupted operation. We do not guarantee that using HBGEN will increase sales, traffic, followers or ad performance, or that any ad will be approved.
14. Limitation of liability
To the fullest extent permitted by law, HERBIDEX and its owners, staff and partners are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of HBGEN. Our total liability for any claim is limited to the amount you paid us for the service in the 3 months before the event that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
15. Indemnity
You agree to defend and compensate HERBIDEX against claims, losses and costs (including reasonable legal fees) arising from Your Content, your products or campaigns, your breach of these Terms or the law, or your breach of a third-party platform’s rules.
16. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. We will first try to resolve any dispute informally by email. If that fails, the courts of Nigeria have jurisdiction, except that you may have mandatory consumer rights in the place where you live.
17. Changes to these Terms
We may update these Terms. We will change the “Last updated” date and, for material changes, notify you by email or in the dashboard. If you keep using HBGEN after the changes take effect, you accept them.
